Terms of Service

These Terms of Service ("Terms") govern your use of the Fitnity mobile application and website (the "Service") operated by Fitnity ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use Fitnity. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of a business (as a fitness provider/owner), you represent that you have the authority to bind that business to these Terms.
2. Account Registration
- You must provide accurate and complete information when registering
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately at support@fitnity.in if you suspect unauthorised access
- We reserve the right to suspend or terminate accounts that violate these Terms
3. User Accounts (Members)
As a user (member), you may:
- Browse and discover fitness facilities on the platform
- Purchase fitness plans and memberships from providers listed on Fitnity
- Track your attendance, fitness metrics, and progress
- Post content in the community feed, subject to our content guidelines
- Chat with fitness providers via in-app messaging
4. Provider/Owner Accounts
If you register as a fitness provider (gym owner, yoga studio, sports facility), you additionally agree to:
- Provide accurate information about your facility, plans, and pricing
- Honour all bookings made through the platform
- Maintain the quality of service advertised on Fitnity
- Process attendance check-ins via the QR system provided
- Comply with all applicable local laws and regulations for operating a fitness facility
- Not engage in fraudulent listings or misrepresent your services
Provider accounts are subject to approval by Fitnity. We reserve the right to reject or revoke provider status at our discretion.
5. Payments
- All payments are processed securely by Razorpay, a third-party payment gateway
- Prices displayed on the platform are set by fitness providers and are inclusive of applicable taxes unless stated otherwise
- By completing a payment, you authorise Fitnity to charge the stated amount via your selected payment method
- Payment receipts are sent to your registered email address
- Fitnity charges a platform fee on transactions, which is deducted before provider payouts
6. Cancellations and Refunds
- Cancellation and refund eligibility depends on the policy of the individual fitness provider and the plan type purchased
- Generally, plans cancelled within 24 hours of purchase and before the first use may be eligible for a full refund
- Partially used plans are not eligible for refunds unless the provider has closed or the service was not delivered as advertised
- Refunds, where approved, are processed to the original payment method within 5–7 business days
- To request a refund, contact us at support@fitnity.in with your booking details
7. User-Generated Content
By posting content (photos, videos, text) on Fitnity, you:
- Grant Fitnity a non-exclusive, royalty-free licence to display and distribute that content within the Service
- Confirm that you own or have the right to share the content
- Confirm the content does not infringe any third-party rights
- Retain ownership of your content; you may delete it at any time
We reserve the right to remove content that violates these Terms or our community guidelines without notice.
8. Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent content or reviews
- Harass, threaten, or abuse other users or providers
- Use the Service for any illegal purpose
- Attempt to gain unauthorised access to any part of the Service or another user's account
- Scrape, copy, or redistribute content from the platform without permission
- Interfere with or disrupt the Service or servers
- Create multiple accounts to circumvent restrictions or bans
- Impersonate any person or entity
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind. Fitnity does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not endorse or guarantee the quality, safety, or legality of any fitness facility listed on the platform. Your use of any facility you discover through Fitnity is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Fitnity shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to personal injury sustained at a fitness facility, loss of data, or loss of revenue. Our total liability for any claim shall not exceed the amount you paid to Fitnity in the 3 months preceding the claim.
11. Indemnification
You agree to indemnify and hold Fitnity, its officers, directors, and employees harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
12. Termination
You may delete your account at any time from the app settings. We may suspend or terminate your account immediately if you violate these Terms, without prior notice or liability. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, and 11 survive termination.
13. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms.
